This distinction is critical for insurance agents calling across multiple states from a single office. An agent in New York calling Texas leads at 8:30 PM Eastern time is calling at 7:30 PM Central time, which is legal. But calling California leads at 8:30 PM Eastern is calling at 5:30 PM Pacific — still fine. The key is always the recipient's local time, which means you need to track time zones by state, not just your own clock.

    TCPA violations for calling outside permitted hours carry fines of $500 per call for standard violations and $1,500 per call for willful violations. There is no good-faith exception for time zone errors — if you called outside the permitted window, the violation stands regardless of whether you intended to comply.

    States With Stricter Calling Hours Than Federal Minimums

    While the federal TCPA sets 8:00 AM to 9:00 PM as the national standard, several states have enacted stricter calling windows that supersede the federal rule. When state law is stricter than federal law, you must follow the state standard.

    Connecticut limits telemarketing calls to 9:00 AM through 8:00 PM local time — one hour shorter at both ends of the day compared to federal minimums. Maine restricts calls to 8:00 AM through 8:00 PM, cutting an hour off the evening window. If you are running campaigns targeting consumers in these states, your dialer should be configured to respect the state-specific cutoffs, not just the federal standard.

    Always use the recipient's local time — not your office time — when determining whether a call is within the legal window. This requires knowing the time zone of the number you are calling, which your lead data should include.

    How to Manage Multi-State Campaigns Without Violations

    Insurance agents running outbound campaigns across multiple states face the most complex compliance challenge: a single dialing session may be simultaneously legal in one state and illegal in another, depending on the time. The cleanest approach is to segment your lead lists by state and create separate dialing queues with state-specific start and stop times configured in your dialer.

    For agents using a power dialer or predictive dialer, most platforms allow you to configure "allowed calling hours" per campaign. Set up a separate campaign or list segment for each time zone block — Eastern, Central, Mountain, Pacific, and special cases like Arizona (which does not observe daylight saving time) and Alaska. This way your dialer automatically stops calling each segment when the legal window closes in that time zone, even if you are still within the legal window in your own location.

An agent in New York who starts dialing at 7:45 AM Eastern is calling two hours before the legal window opens for Mountain time contacts. An agent who keeps dialing until 9:15 PM Eastern has been calling Pacific contacts since 6:15 PM — technically fine — but has been calling Central time contacts since 8:15 PM, which is 48 minutes past the legal cutoff.
